WarrantiesProduct Warranty # 901201HQuaker Safety stands behind its products. We warrant for a maximum of five years from the date of manufacture that the products listed on your Quaker Safety invoice will be free from defects in materials and workmanship when used by appropriately trained personnel following acceptable fire fighting or emergency medical operations procedures. We warrant that the product will conform to the description furnished in our catalog and, only where specified in respect of particular goods, to National Fire Protection Association (NFPA) standards as in effect on the date of our acceptance of your order. Where a sample has been furnished by us or by you, and we have agreed to supply product according to such sample, Quaker Safety warrants that the whole of the product shall conform to such sample. THESE EXPRESS WARRANTIES ARE IN LIEU OF ANY OTHER WARRANTIES,EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Quaker Safety's obligations under this warranty are limited to, at our option, (I) repair or replacement of the product without charge, or (II) granting a credit to be applied to the purchase of an equal or better protective garment from us, or (III) a refund of the original purchase price. These warranty obligations apply only to any product which is returned to Quaker Safety, with proof of purchase, and which is determined to Quaker Safety's satisfaction to be defective as covered by this warranty. QUAKER SAFETY DISCLAIMS ANY LIABILITY FOR ANY INJURY, LOSS OR DAMAGE, DIRECT, INDIRECT, OR CONSEQUENTIAL, ARISING OUT OF THE IMPROPER USE OR THE INABILITY TO USE THE PRODUCT DURING THE WARRANTY PERIOD. BEFORE EACH USE, USER SHALL DETERMINE THE SUITABILITY OF THE PRODUCT FOR HIS/HER INTENDED USE. Please refer to the warning labels contained in, and the FEMSA Official User Information Guide supplied with your protective garment for further instructions. This warranty policy does not cover measuring errors, outer shell material shading variations, degradation of hook & loop tape caused by cleaning solutions containing D-Limonene, damage to protective garments caused by improper storage practices, or damage to thermal liner material face cloth caused by contact with hook & loop tape when pant pocket flaps are not kept in the closed position. PURCHASER, BY THE USE OR RESALE OF THIS PRODUCT, SHALL BE DEEMED TO ACCEPT AND AGREE TO THESE WARRANTY PROVISIONS. Repair Warranty # 901202DAll repairs done by Quaker Safety are on a “satisfaction guaranteed” basis, which shall be deemed to be satisfied upon acceptance by the customer of the protective garment, which shall occur if the repaired protective garment is not returned to Quaker Safety within 5 days after receipt by the customer. All such repairs shall be deemed to be for cosmetic purposes only. Except for the foregoing, the customer agrees that Quaker Safety provides no warranty, express or implied, on the repair. The customer agrees that any repairs undertaken by Quaker Safety do not impose upon Quaker Safety any liability should the protective garment or the repair fail to perform its function. The repair work shall not be deemed to renew, extend; modify, or affect in any manner whatsoever any Quaker Safety warranty which may be in effect or which may have existed in respect of the protective garment. |
